4. Trend to challenge anti-money laundering law irks SC
The apex court on Tuesday deprecated and stopped a concerted attempt by some accused in money laundering cases to challenge the validity of certain provisions of PMLA in order to plead for interim relief of “no coercive step” by the Enforcement Directorate.

Petitions
  • Dealing with a batch of petitions by accused in the alleged liquor scam case in Chhattisgarh, a vacation bench of the top court said such petitions challenging the Prevention of Money-Laundering Act (PMLA), and in the process seeking consequential reliefs, amounts to bypassing other available legal remedies.
‘Already decided’
  • “The court is constrained to observe that despite the Vijay Madanlal judgment there is a trend prevailing in writ petitions filed before this court under Article 32 challenging the constitutional validity of Sections 15 and 63 and other provisions of the PMLA, which has been decided…” it said.
  • Article 32 of the Constitution gives individuals the right to approach the Supreme Court if they feel their fundamental rights have been violated.
ED's power
  • On July 27 last year, the Supreme Court had in the ‘Vijay Madanlal Chaudhary vs Union of India' case upheld the ED’s powers to arrest, search and seize property under the PMLA.
A rebuke
  • When lawyers representing the accused realised that their pleas challenging validity of PMLA would not earn them the shield from arrest, they sought to withdraw the petitions. But, the vacation bench ensured that they would not come back with the same challenge later.
  • The court said it was the duty of senior advocates to guide the briefing counsel about the fallacy in the approach -- to mount fresh challenges to provisions of a legislation which have been upheld by the SC.

India’s growth momentum is likely to continue in 2023-24, RBI said, even as it made a case for pushing structural reforms to deal with the geopolitical developments and also to achieve sustained growth in the medium-term.

Risk factors
  • RBI’s annual report flagged slowing global growth, protracted geopolitical tensions and a possible upsurge in financial market volatility as possible downside risks to growth.
GDP
  • Amidst strong global headwinds, the Indian economy is expected to have a growth of 7% in real GDP in 2022-23.
Surplus govt transfers
  • The size of RBI's balance sheet increased by 2.5% during the financial year to Rs 63.45 trillion from Rs 61.90 trillion in FY22, following which it transferred a surplus of Rs 874.16 billion to the government.
Inflation
  • With a stable exchange rate and a normal monsoon -- unless an El Nino event strikes -- the inflation trajectory is expected to move down over 2023-24, with headline inflation edging down to 5.2 % from the average level of 6.7 % recorded last year.
Forex gains
  • The central bank's net income rose to Rs 2.35 trillion rupees ($28.4 billion) in the fiscal year 2023, from Rs 1.6 trillion in the previous year on higher forex gains.
  • During the year, RBI saw a gain of Rs 1.03 trillion from foreign exchange transactions, which allowed it to increase the size of its contingency fund, the report showed.
Digital transactions
  • In 2022-23, total digital payments recorded a growth of 57.8% and 19.2% in volume and value terms, respectively, on top of growth of 63.8 % and 23.1 %, respectively, in the previous year.
